Mobile Call on Behalf of High Court Judge Stops Session Judge From Hearing Bail Plea

On Monday, a Session Judge at Srinagar recorded his inability to hear a bail plea for the reason that a phone call purportedly conveyed that a J & K High Court Judge has directed that the bail application be not allowed.

This has happened in the case of Sheikh Salman v. JKUT through SHO P/S Saddar, Srinagar

The Principal Sessions Judge Abdul Rashid Malik has recorded in his order that he received a phone call from the Secretary to Justice Javed Iqbal Wani of the J and K High Court at 9.51 am on Monday when the bail plea was listed to be heard.

Recording the aforesaid the Session Judge has directed to forward the bail application before Registrar Judicial of the High Court, so that it may be placed before the Hon’ble Chief Justice of Jammu and Kashmir High Court, as issue pertains to liberty of an individual.

Further the court had directed the Petitioner Counsel to appear before the Registrar of High Court on the same day.

In this case the bail application pertained to offences under Section 307, 341 and 323 of IPC,

This matter was thereafter heard by the Registrar of the J and K High Court who directed the another district and sessions judge to hear the bail application, a state law officer said.

He added that in this matter the accused was granted bail on Wednesday.
