Mediation Cannot Be Thrusted Upon Unwilling Parties in Family Disputes Not Governed by Commercial Courts Act: Bombay High Court

The High Court of Judicature at Bombay has held that parties in a civil suit, even if closely related, cannot be referred to mediation if one of them is unwilling. The court observed that while mediation is preferable in family disputes, the Mediation Act, 2023, and Section 89 of the Code of Civil Procedure (CPC)
