Lawyers Chamber Demolished in Lucknow- All HC Seeks Govt’s Response on Rehabilitation Scheme

The Allahabad High Court at Lucknow has directed the UP Government to file an affidavit regarding the steps taken by the Government to rehabilitate the Advocates whose chambers were recently demolished in Lucknow Sadar Tehsil Court.

It has been alleged that such demolition exercise was undertaken without issuing any prior notice.

A Division Bench comprising Hon’ble Justice Pankaj Mithal and Hon’ble Justice Manish Kumar has passed the Order on a PIL filed by some Advocates.

Shri H.J.S Parihar, Senior Advocate, appeared for the Petitioner in this matter. It has been stated in the PIL that Chambers of several Advocates in the Sadar Tehsil at Lucknow has been demolished on November 16, 2020, without any show-cause notice.

The Court found that the Standing Counsel representing the Government was not in a position to explain the reasons behind such action or whether any prior notice was given to the Lawyers or not.

Considering the above, the Allahabad High Court at Lucknow has directed the Standing Counsel to take instructions in the matter and file an Affidavit.

The Affidavit shall specifically state about the scheme (if any) for the rehabilitation of Advocates by constructing new chamber building for Lawyers at Tehsil Sadar Lucknow.

In the meantime, the Court has provided interim protection that no further demolition of the remaining 74 chambers shall be done by the authorities.

Nex date of hearing is December 9, 2020.
