GST Appellate Tribunal For UP shall not be established without leave of the Court: Allahabad HC at Lucknow

On Thursday, the Bench of Hon’ble Chief Justice Govind Mathur and Hon’ble Justice RR Awasthi at High Court Lucknow heard the Petition filed by the Awadh Bar Association challenging the decision of GST Council to constitute its State Bench at Prayagran and Area Bench at Lucknow.

The Bench recorded that the Additional Solicitor General of India has instruction that the Government will file a SLP before the Supreme Court challenging the correctness of Judgment dated 09.02.2021 passed in Writ Tax No. 655 of 2018 by a coordinate bench at Allahabad.

Considering the submissions of the Counsels, the Bench admitted the Petition and provided that Respondent 1 and 2 shall not establish Goods and Services Tax Appellate Tribunal for the State of Uttar Pradesh without leave of this Court.

The case has been fixed for 15.03.2021 for final disposal
