Judicial Magistrate First Class, Satara has ordered Maharashtra police to register a case against a woman for lodging a false rape complaint against two men and also for giving a false statement in the Court.
The order was passed after the police stated that they could not find any evidence against the accused and filed a closure report.
After going through the case’s facts, the Magistrate opined that the woman had filed a false complaint intending to cause injury to the accused even though she knew that there were no just grounds to file the complaint.
In her complaint, the woman had stated that the accused had raped her under the pretext of giving her a job and a case u/s 376(d) was registered.
In the course of the investigation, police found that one of the accused was not even in India, and the vehicle where the alleged crime took place was not in possession of either the accused.
The police mentioned these facts in the B summary report which the woman opposed by filing a protest petition.
After considering the report and grounds of the case, the Court accepted the B summary report.
The Court remarked that the woman had given a false statement to the police and she also gave a false statement on u/s 164 of CrPC to the Magistrate despite knowing that the FIR lodged by her was false.
In this regard, the Court directed Assistant Superintendent of Civil and Criminal Court, Wai, Maharashtra to file a case against the woman for offences punishable u/s Sections 193, 194 (false evidence), u/s 199, 200 (false declaration under law) and also u/s 211 (false charge of offence) of the IPC.
