A PIL came up before the Allahabad High Court seeking postponement of Elections of Municipal Corporation in view of the Pandemic
The Petitioner sought following reliefs:
“(i) Mandamus directing the respondent no.3 and 4 to postpone the coming election of Moradabad Municipal Corporation Employees’ Union for the year 2020-2022 unless and until there is guideline of Ministry of Home Affairs, Government of India, permitting with a ceiling of 750 people.
(ii) Mandamus commanding the respondent no.2 to ensure the strict compliance of the guidelines of Unlock 4.0 dated 29.08.2020 issued by Ministry of Home Affairs, Government of India, by the employees/voters of the Moradabad Municipal Corporation Employees’ Union.
(iii) Issue any other writ, order or direction as this Hon’ble Court may deem fit and proper in order to provide a sigh of relief to the inhabitants of Moradabad who are in the grip of tension and frustration due to pandemic disease COVID-19.”
The submission of the counsel for the petitioner was that looking to the rapid surge of COVID-19 virus, it is not in the interest of the public at large to allow elections of Municipal Corporation Employees’ Union.
The Division Bench of Hon’ble Chief Justice Govind Mathur and Hon’ble Justice Siddharth Varma observed:
During the period of the pandemic, all offices, businesses, professions are in operation with the necessary protection. The elections of Employees’ Union may also be conducted with the necessary protection and, therefore, there is no need to issue any direction as prayed for.
With the aforesaid observation, the writ petition is dismissed.
