Delhi MACT Awards ₹75.67 Lakh to Man Who Lost Leg in Road Accident; Terms Disfigurement a Lifelong Deprivation

A Motor Accident Claims Tribunal (MACT) in Delhi has awarded ₹75.67 lakh as compensation to a 23-year-old man who lost his right leg below the knee after a speeding truck hit his scooter near the Sarita Vihar Metro Station in August 2023.

Presiding Officer Shelly Arora observed that the accident caused “immense physical and emotional trauma” and permanently altered the victim’s life. The tribunal, in its order dated October 30, 2025, held the truck driver guilty of rash and negligent driving and directed the insurer, New India Assurance Co. Ltd., to deposit the compensation.

The injured man, Anil, was riding with two friends—Krishnan Gopal, who died on the spot, and Ketan Kumar, who sustained injuries—when the truck rammed into their scooter from behind.

Noting that Anil suffered 70% permanent disability, the tribunal said:

“The injured has his right (side) below knee amputated. Disfigurement basically means something which is not in form or shape or figure which implies that the appearance of someone was spoiled on account of injuries sustained in the accident.”

It further said the award compensates for not only medical expenses and loss of income but also loss of amenities of life and the deprivation Anil would endure due to his disability.

While calculating the damages, the tribunal emphasised that compensation must take into account the age of the victim and his inability to enjoy the basic amenities of life as any other normal person can.

“It compensates the victim on account of his inability to enjoy the basic amenities of life as any other normal person can, taking into account the age and the deprivation he would have to undergo and suffer due to injuries,” the order stated.

Finding the truck driver solely responsible for the accident, the tribunal awarded ₹75.67 lakh under various heads, including medical expenses, loss of future earning capacity, pain and suffering, disfigurement, and cost of prosthetic aid.

The tribunal directed New India Assurance Co. Ltd. to deposit the awarded amount, ensuring the victim’s long-term financial security and rehabilitation.
