The Delhi High Court has decided to treat BJP leader Subramanian Swamy’s plea, which seeks action on his request to the Ministry of Home Affairs (MHA) to cancel Congress leader Rahul Gandhi’s Indian citizenship, as a public interest litigation (PIL). The decision came during a session on Tuesday, where Justice Sanjeev Narula questioned the basis of Swamy’s legal standing in the matter.
During the hearing, Justice Narula expressed difficulty in identifying any legally enforceable right that Swamy could claim, suggesting that the plea’s nature might only be justifiable as a matter of public interest. Responding to this, Swamy, who was representing himself, agreed that if the court deemed it suitable, the plea could be forwarded to a bench specializing in PILs, emphasizing that his actions were not for personal gain but were matters of national concern.
Swamy’s plea involves an allegation that Rahul Gandhi misrepresented his nationality as British in communications with the UK government, which, according to Swamy, could disqualify Gandhi from his Indian citizenship under Article 9 of the Constitution and the Indian Citizenship Act. Swamy claims that despite his representations to the MHA since August 6, 2019, there has been no substantial progress or feedback on the issue.
