The Allahabad High Court had asked the UP government to constitute a fresh commission to inquire into the allegations of Police personnel beating lawyers when they were protesting peacefully.
The Standing Counsel who appeared in the case informed the Court that earlier, a Commission headed by a retired Judge was appointed to look into the matter.
However, the Commission recommended that the case should be closed and things will get pacified with the passage of time.
To this statement, the Court remarked that they were not making observations on the recommendation made by the Commission which was tasked with submitting a report and not to make it infructuous with efflux of time.
It was further observed that the issue before the Court could not be closed and it has been suggested that the case should be taken to a logical conclusion.
The logical conclusion in Court’s opinion was needed in order to maintain discipline in the police force and in the administration who had mercilessly beaten the protesting advocates who sustained severe injuries.
Learned state counsel submitted that the Commission was unable to complete the inquiry as the state authorities did not provide necessary facilities and infrastructure.
Hon’ble Allahabad High Court directed the State government to form a new commission to look into the case as the effort of the government is to run a clean administration and facilitate everyone.
The Court further ordered that a proper inquiry should be conducted and a report should be submitted so that the government can take a proper decision in the case.
Next date of hearing is 05.01.2021, and the parties can seek instructions for the fresh constitution of the Commission and its report.
