Cannot convict a co-accused if a main accused is acquitted on examining the same witnesses for the same allegations: Allahabad High Court

The Allahabad High Court recently stated that considering the testimony of witnesses where one accused is acquitted, then no criminal proceedings could be sustained against the same co-accused in relation to the same witnesses in the same case. The Bench of Justice Suresh Kumar Gupta made these observations as it quashed u.s 364A r.w 34
