Madhya Pradesh High Court Acquits Eight In 1998 Teacher Recruitment Corruption Case

The Madhya Pradesh High Court has set aside the conviction of eight individuals sentenced in connection with alleged corruption during a 1998 teacher recruitment drive, ruling that the prosecution failed to establish criminal intent and relied on hostile witnesses and unverified evidence.

Allowing the criminal appeals, Justice Jai Kumar Pillai overturned an August 12, 2010 judgment by the First Additional Sessions Judge and Special Judge under the Prevention of Corruption Act. The trial court had previously sentenced the eight appellants to two years of rigorous imprisonment and imposed a fine of 10,000 rupees each, with an additional six months of imprisonment in default of payment.

Hostile Witnesses And Flawed Evidence

In its assessment, the high court highlighted significant evidentiary gaps, noting that key complainants and job applicants turned hostile during trial proceedings. Witnesses disowned the initial complaints or testified that Lokayukta Police officers directed them to sign the documents. The court stated that when the originators of complaints disown the underlying records, the foundation of the prosecution’s case becomes highly suspicious.

The court also identified serious deficiencies in documentary proof. Investigators relied on photocopies of voter lists and family registers to allege family ties between selection committee members and candidates. However, during cross-examination, the local Tehsildar acknowledged an inability to verify those records because police provided only photocopies rather than original documents. The court determined that securing convictions based on unverified photocopies alongside hostile witness testimony was legally unsafe.

Distinction Between Administrative Fault And Crime

Addressing the trial court’s rationale, which centered on appellants failing to declare relationships with candidates, the high court held that the lower court had incorrectly conflated an administrative breach with a criminal offense.

The ruling clarified that while a panchayat member using official authority to benefit relatives may face removal or disciplinary proceedings under the Panchayat Act, such actions do not automatically constitute an offense under the Prevention of Corruption Act. To secure a criminal conviction, prosecutors must prove dishonest intention and the receipt or demand of financial gain. The court observed that the record contained no evidence of bribery or monetary rewards, adding that interview scoring remains a matter of personal judgment and that prosecutors presented no proof that chosen candidates lacked merit.

The high court further rejected allegations against administrative officials, including Chief Executive Officer Ashok Kumar Pandey and Block Education Officer Vijay Rege. The court ruled that supervisory officers cannot be held vicariously liable for the independent scoring decisions of other committee members. It noted that independent experts on the panel described the process as transparent, preventing the prosecution from disregarding its own non-hostile witnesses. Additionally, the court found that statutory sanction to prosecute the public servants had been granted without independent evaluation of the evidence.

The matter stems from the 1998 selection of 207 Grade-III Shikshak Karmi teachers in the Sanwer Janpad Panchayat. Out of 2,539 applicants, 1,796 candidates participated in interviews held between June 27 and July 18, 1998. Following complaints of nepotism and favoritism, the Lokayukta’s Special Police Establishment initiated proceedings, alleging that committee members awarded maximum interview marks to relatives with assistance from local administrative officers.
