Allahabad High Court Reminds Trial Judges to Record Injuries in Judgments, Flags Non-Compliance with Longstanding Circulars

The Allahabad High Court has issued a firm reminder to trial courts across Uttar Pradesh to strictly record injuries of victims in their judgments, noting that this requirement—spelled out in two earlier High Court circulars—continues to be ignored in some cases.

A division bench of Justices Rajeev Mishra and Ajay Kumar made the observation while dismissing a criminal appeal filed by Sunil Kumar Yadav. The judges said they were “pained to observe” that the trial court had not mentioned the injuries found on the body of the deceased in the judgment under challenge, despite clear guidelines mandating such recording.

The bench pointed to two High Court circulars dated March 3, 1982 and March 3, 2002, which explicitly instruct judicial officers to reproduce injury details from medical reports in their decisions. These requirements, the court said, are essential for a complete and proper judicial assessment.

The order emphasised:
“We hope and trust that the aforesaid circulars shall be complied with by all the judicial officers while writing their judgments.”

To ensure uniform adherence, the court directed that a copy of its judgment be circulated to all judicial officers in Uttar Pradesh.
