Allahabad High Court Quashes Moradabad DM’s Order Asking Samajwadi Party to Vacate Bungalow

The Allahabad High Court has set aside the Moradabad district administration’s order that directed the Samajwadi Party (SP) to vacate the bungalow currently housing its district office.

On September 16, 2025, Moradabad District Magistrate (DM) Anuj Singh had cancelled the allotment of Kothi No. 4, located in the Chakkar Ki Mill area of Civil Lines. The bungalow had been in the name of late SP founder Mulayam Singh Yadav for the past 31 years. Along with the cancellation, the DM issued a notice asking the party to vacate the premises within 30 days.

Subsequently, on October 6, the local administration attempted to take possession of the bungalow by force. SP workers, however, sought time until October 10 to vacate the property.

The matter reached the High Court through a writ petition filed by SP leader Jaiveer Singh, challenging the DM’s action. The case was heard by a division bench comprising Justice Arindam Sinha and Justice Satya Vir Singh.

The petitioner’s counsel argued that the DM’s order was “malicious and without jurisdiction”, asserting that the allotment was lawful and had been maintained for decades. The lawyer further contended that the property in question belongs to the Nagar Nigam (municipal corporation), and therefore, the District Magistrate had no authority to issue a vacation notice or take possession.

On behalf of the district administration, it was argued that the bungalow was state government property, with the Nagar Nigam merely acting as its custodian. Hence, according to the administration, there was no illegality in the DM’s decision to cancel the allotment and initiate the vacation process.

After hearing both sides, the High Court set aside the DM’s order, effectively restraining the district administration from evicting the Samajwadi Party from the premises. The bench observed that the administrative action was not legally sustainable in light of the ownership and jurisdictional issues raised.
