High Court Demands Response from Punjab Government Over Release of HIV Positive Blood

The Punjab and Haryana High Court has labeled the release of HIV positive blood by a Phagwara blood bank as “gross negligence” and has issued a notice to the Punjab government, the Director-General of Police, and other relevant authorities seeking a response.

During a hearing, it was revealed that on August 1, 2023, the said blood bank had released three units of HIV positive blood. Despite the filing of a complaint by the petitioner, no actions were taken by the police. Additionally, another incident was reported where a patient with O-positive blood group was transfused with B-positive blood on October 10, 2020, in Bathinda.

The petitioner has emphasized that the negligence of blood banks and their staff has serious repercussions on patients and has called for stringent guidelines to be issued for blood collection, storage, testing, and distribution. They have also requested the High Court to make provisions for compensation for those affected by such negligence.

The petition appeals for proper treatment and compensation for the victims who were administered HIV positive blood and demands strict action against the culprits involved. The High Court has now ordered the respondents, including the Punjab government, to file their responses.
