Why Justice Yashwant Varma Was Sent Back Despite Suspension of His Judicial Role

In a significant move aimed at maintaining the functionality of the Delhi High Court, the Supreme Court collegium decided to transfer Justice Yashwant Varma to the Allahabad High Court following his suspension from judicial duties. This decision was precipitated by an ongoing inquiry into allegations linked to the discovery of substantial amounts of cash at his official residence in Delhi.

Justice Varma, a senior figure in the Delhi High Court, was intricately involved in both the collegium and key administrative committees. His continued presence in Delhi, despite the suspension of his judicial functions, threatened to cause an administrative deadlock, halting vital judicial processes and decision-making within the High Court.

According to sources close to the collegium, “Justice Varma’s involvement in crucial bodies meant that their operations could potentially freeze if he remained in Delhi without a resolution to his case.” This situation necessitated his transfer to avoid disruption of the court’s essential functions.

The unanimous decision to repatriate Justice Varma to his parent institution in Allahabad was made during the collegium’s meeting on March 20. Justice Varma consented to the transfer, which aims to facilitate the continuation of judicial and administrative work in Delhi while the inquiry proceeds without hindrance.

Despite his reassignment, the Justice will not hold positions in the Allahabad High Court’s collegium or administrative committees, reducing his influence and involvement in critical judicial processes at his new posting. This strategic move is intended to preserve the integrity of court operations both in Delhi and Allahabad.
