Who is “Aggrieved Person” to file an appeal U/s 96 CPC

On 21.08.2020, a bench of the Supreme Court comprising Justice L. Nageshwar Roa, Justice Krishna Murauri, Justice S. Ravindra Bhatt,

delivered Judgment in the case of

SRI V.N.KRISHNA MURTHY & ANR. ETC vs SRI RAVIKUMAR & ORS. (CIVIL APPEAL NOS. 2701-2704 OF 2020 ),

answering the question as to who is “Aggrieved Person” to file an appeal under Section 96 & 100 of C.P.C.

Aggrieved Person as per Supreme Court:

A Stranger is not allow to file and appeal in any proceedings

unless he satisfies the court that he is cover under the definition of aggrieved person.

Court said: Appellants are not aggrieved person. So, there are not bound by decree.
