WhatsApp Challenges the New IT Rules 2021; Pleads Privacy Violation

The popular messaging app WhatsApp has moved Delhi High Court and has challenged the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules to the extent that the Rules needs intermediary platforms to make provisions for identifying the first originator of information.

As per reports, WhatsApp has argued that the provision was unconstitutional and was against the fundamental right to privacy, as mentioned in the Apex Court judgement.

It is contended that the provision goes against the concept of end to end encryption. It would make it mandatory for private companies to collect and store the data of billions of conversations just for the requirement of law enforcement agencies.

Thus, WhatsApp prayed that the said provision should be declared unconstitutional. It also requested that the provision should not come into force and prayed that its management and employees should not be held criminally liable for non-compliance.

As per the new Rules, 25th May was the last date to comply with the new Rules.
