A Motor Accident Claims Tribunal (MACT) in Delhi has awarded ₹82.86 lakh as compensation to the family of Vineet Sehrawat, a 34-year-old Delhi Fire Services (DFS) personnel who died in a road accident in 2016.
The claim was filed by the family of Sehrawat, who was fatally injured when his motorcycle was struck by a Haryana Roadways bus on February 27, 2016. The accident occurred near Gagadwaas Village in Bhiwani district, Haryana.
The petitioners contended that the accident was a result of rash and negligent driving by the bus driver. They sought compensation under the Motor Vehicles Act for the untimely demise of Sehrawat, who was the sole earning member of the family.
Presiding Officer Richa Manchanda, in an order dated February 7, observed that the petitioners had successfully established their case. The tribunal relied on an eyewitness account and supporting evidence from the criminal case to conclude that the bus driver was indeed at fault.
“Considering the fact that the deceased was aged about 34 years at the time of accident and was a government employee, future prospects that are 50 per cent have to be awarded in favour of the petitioners,” the tribunal held.
The tribunal awarded a total of ₹82.86 lakh under various heads, including loss of dependency, loss of consortium, funeral expenses, and future prospects. It further noted that the Haryana Roadways bus involved in the accident was insured at the time.
Accordingly, the tribunal directed the insurance company to disburse the compensation amount to the deceased’s family.
