Reacting to the controversy that arose last week regarding oral observations made by CJI Bobde during a bail hearing in a rape case on Monday, CJI Bobde stated that his remarks were completely misreported. He also observed that the Supreme Court has always given the largest respect to women.
CJI Bobde added that even in that case, the Bench never suggested that the accused should marry the victim but only asked the question. This was about bail proceedings that occurred last week when the CJI asked a twenty-three-year-old man if he would marry the rape victim.
The new statements were made when the Bench was hearing an application seeking a fourteen-year-old rape victim’s abortion.
After getting the relief, counsel for the victim stated that the Court has been very generous to the victim. CJI replied that it was good to hear that as they had heard opposite opinions in the last 2 weeks.
The Counsel stated that he was against such reports that tarnish the image of the court.
Solicitor General Tushar Mehta, who was also present during the hearing, stated that the Court’s remarks were twisted and were taken out of context.
However, the CJI stated that as an institution and Court, they had the highest respect for womanhood.
Petitioner’s Counsel replied that many people tarnish the judiciary’s image, and there should be some mechanism to deal with such people. CJI replied that their reputation was in the hands of the Bar, and they didn’t need such a mechanism.
