A 36-year-old pharmaceutical company employee who suffered permanent physical impairment following a vehicular collision in 2019 has been awarded Rs 20.17 lakh in compensation by the Thane Motor Accident Claims Tribunal.
Tribunal member R.V. Mohite, who evaluated the victim’s functional disability at 10 per cent, ordered that Rs 5 lakh of the total compensation sum be placed in a fixed deposit under the claimant’s name for a duration of three years.
Findings On Negligence
In the ruling, the tribunal established that the offending vehicle, a Tata Magic pick-up van, was being driven at high speed at the time of the impact, establishing rash and negligent conduct on the part of the driver.
The tribunal further observed that the evidentiary record contained no material to suggest any contributory negligence on the part of the motorcyclist, Rahul Dattatreya Thombare.
Background Of The Incident
The incident occurred on December 4, 2019, along the Boisar-Nandgaon roadway. Thombare sustained severe physical injuries when the pick-up van struck his motorcycle, ultimately leading to permanent functional impairment.
