Thane MACT Awards ₹12.74 Lakh Compensation to Man Injured in 2020 Motorcycle Accident

The Motor Accident Claims Tribunal (MACT) in Thane, Maharashtra has awarded ₹12.74 lakh as compensation to a 27-year-old man who sustained grievous injuries in a 2020 road accident involving a dumper truck.

MACT member R.V. Mohite, in an order passed on February 4, directed the owner of the offending vehicle and its insurer, Tata AIG General Insurance Co. Ltd., to jointly and severally pay the amount with 9% interest per annum from the date of filing the claim.

The claimant, Rajesh Kumar Sadhu Saran Yadav, was riding pillion on a motorcycle on September 14, 2020, travelling from Chembur towards Bhayander. On the Eastern Express Highway in Vikhroli, a dumper truck collided with the two-wheeler, causing it to skid. The dumper subsequently ran over Yadav, resulting in severe injuries to his legs.

He later filed a compensation claim under the Motor Vehicles Act before the MACT.

After evaluating the evidence, including medical records and witness testimonies, the tribunal found that the accident was caused due to the rash and negligent driving of the dumper. It further held that Yadav had suffered 20% functional disability.

The tribunal quantified the compensation under various heads including future loss of income, medical expenses, pain and suffering, and other incidental costs, arriving at a total of ₹12,74,000.

The tribunal ordered that ₹3 lakh out of the total sum be kept in a fixed deposit for a period of three years, while the remaining amount should be transferred directly to the claimant’s bank account. Tata AIG has been instructed to deposit the compensation within one month.
