SC sentences man to three-month imprisonment for failing to pay Rs. 1.6 core maintenance to estranged wife

In a recent case, the Supreme Court ordered a man to undergo three months of civil jail because he failed to pay Rupees 1.06 crore maintenance to his estranged wife.

A three-judge bench comprising Hon’ble CJI SA Bobde, Hon’ble Justice AS Bopanna and Hon’ble Justice V Ramasubramanium passed this order after noting did not pay the maintenance even though the Court gave him the last chance.

In the order, the Court stated that the respondent has committed contempt of Court and should undergo imprisonment for three months.

In its order dated 19.02.2021, the Court gave the man one last opportunity and ordered him to pay arrears of maintenance and monthly maintenance of Rs 1.75 lakh to his estranged wife.

When the case was taken up on 22nd March, the wife submitted that the respondent has complied with the Court’s order and has only made partial payments.

Counsel for the respondent sought more time from the Court; however, the Court declined and stated that the respondent has not utilized his last chance and proceeded to sentence him to three months imprisonment in civil jail.
