Public Land in UP is Most Vulnerable to Encroachment: Allahabad HC

In an important observation, on Thursday the Allahabad High Court stated that Public land is most vulnerable to encroachment.

Hon’ble Justice Ajay Bahot stated that the only answer the UP government has to the endemic of encroachment was Uttar Pradesh Revenue Code.

Case Before the Court:-

The petitioner alleged that he had intimated the competent authority about the encroachment of land, but the authority failed to discharge its duties u/s 67(2) of Uttar Pradesh Revenue Code, 2006. The counsel also stated that the instant case has been pending for too long, and if the encroachment on public land is not checked, it would irreversibly damage the general public.

Observations and Directions of the Court

Hon’ble Court observed that the officers charged with clearing the encroachment should do their duties in a timely and efficient manner. The Court also stated that such officers are legally obligated to clear encroachments.

The Bench directed the standing counsel to obtain instructions from the authority why the authority did not discharge its statutory duties.

Next date of hearing in the instant case is on 05.02.2021.
