The Allahabad High Court has declined to entertain a writ petition filed by the Samajwadi Party challenging the Pilibhit civic body’s order directing it to vacate its local party office premises.
A division bench comprising Justice Ashwani Kumar Mishra and Justice Jayant Banerji noted that since the party had already sought remedy before the Civil Court on the same issue, it could not pursue parallel proceedings. “The petitioner cannot be allowed to avail two simultaneous remedies for the same cause of action,” the bench observed while dismissing the plea.
The civic body had passed the eviction order on November 12, 2020. The Samajwadi Party alleged that the order was issued without granting it an opportunity of being heard.

Earlier, on June 16, the Supreme Court had also dismissed a plea by the party against the same civic body decision and barred the party’s Pilibhit district president from initiating fresh litigation on the matter.
