The Madras HC on Tuesday granted bail to a person who was arrested for attempting to commit rape of a mentally unstable girl.
According to the prosecution story, the petitioner and the victim were neighbours. The victim was a mentally unstable person. Taking advantage of the same, the petitioner trespassed into the house of mentally unstable victim girl and sexually assaulted her. The victim girl raised alarm and thus was rescued by other neighbours of the society. Consequently, the petitioner was arrested and sent to judicial custody on 25/01/2021.
The advocate on behalf of the petitioner submitted that there is a civil dispute pending between the petitioner and the defacto complainant. The complaint given against the petitioner is false and is in relation with the same civil dispute.
Also the petitioner has been incarcerated since two months. Thus the petitioner should be enlarged on bail, urged the counsel on behalf of the petitioner.
The court granted bail to the petitioner considering the time that he has been incarcerated on a bail bond of Rs 10,000/-.
