On Monday, the Supreme Court heard a plea from the parents of a rape convict seeking custody of the child conceived as a result of the rape assault.
The case was being heard by a bench led by Chief Justice of India DY Chandrachud.
Following the mention of the case, Justice PS Narasimha inquired, “What are you saying here?”
Then CJI Chandrachud expressed surprise, saying, “Your son is in jail for rape, and you want that child handed over to you?” “Where will the child be if not with the mother?”
The parents’ lawyer argued that “it is in the best interests of the child Milord.”
“What kind of petitions (are) coming to this court?” asked CJI Chandrachud. In this case, how will a habeas corpus be granted?”
