Non-Bailable Warrant Issued Against LDA VC and Secretary

The District Consumer Dispute Redressal Commission Lucknow has issued Non-Bailable Warrant against the Vice Chairman and Secretary of  Lucknow Development Authority.

District Forum has directed the Police Commissioner to arrest and produce the Vice Chairman and Secretary of  Lucknow Development Authority on 13.10.2020

The Order has been passed in the case of Mahboob Ali vs LDA

As per the Order dated 28.09.2020 in a consumer dispute an award has already been passed in favour of Mahboob Ali (Complainant) and the  Lucknow Development Authority has lost the appeal before the National Consumer Dispute Redressal Commission.

Despite the finality of the matter before the National Commission, the  Lucknow Development Authority did not comply with the order of the commission.

It has been mentioned in the order that earlier on 27.04.2018 an affidavit was filed on behalf of the Lucknow Development Authority that the Order will be complied by July 2018. However, no action has been taken till till date

The Order further says that the  Lucknow Development Authority has been continuously taking adjournments and avoiding the compliance of the order.

On the aforesaid count, the Complainant filed an application for issuance of non-bailable warrant against the Vice Chairman and Secretary of  Lucknow Development Authority

Surprisingly, as per the order, the counsel for the Lucknow Development Authority supported the application of the complainant and submitted before the forum that a direction should be issued to Vice Chairman and Secretary to appear in person before the forum and explain why they have not complied with the order.

After hearing the parties, Forum found that the case is pending since last 15 years and the authorities of LDA are avoiding the compliance on one count or other and there is no expectation that they will comply the orders.

Therefore the Forum issued Non-Bailable warrant against Shri Shivakant Dwivedi (Vice-Chairman) and Anil Bhatnagar (Secretary) of Lucknow Development Authority and directed the Police Commissioner Lucknow to arrest and produce them on the nextd ate of hearing i.e. 13.10.2020.
