Due to the cancellation of the CBSE class 10 and 12 exams, a petition has been filed in the Delhi High Court seeking a refund of exam fees collected from the students.
Petitioner in the case is one Deepa Joseph, who describes herself as a social activist and an advocate and states that her child is in class 10 (CBSE).
Her child’s fees are Rs 2100 for the class 10 exam, but the board exam fee should be returned as the exams have been cancelled. The exam fee for class 12 is Rs 1500, Rs 150 for each practical exam and Rs 300 for the 6th subject.
The petition states that the said that the exam fees levied are used to cover different expenses related to conducting exams. As the exams have been cancelled, the authorities will not have to use the Centre.
A reference is made to an RTI inquiry which stated that for class 10, registered students were 21,50,759, and for class 12, it was 14,30,258, which means that the Board has collected crores in examination fees.
Therefore, the petition seeks a writ of mandamus directing the Board to return the fees for the academic year 2020-2021. The plea further seeks to formulate a mechanism wherein the fee is refunded for unforeseen circumstances like a pandemic.
