No Embargo on High Court to Entertain Writ Petition Against Its Own Administrative Order: Supreme Court

In a significant legal clarification on the maintainability of challenges against judicial administration, the Supreme Court of India has ruled that there is no restriction preventing a High Court from hearing a challenge against its own administrative decisions. A bench comprising Justice Joymalya Bagchi and Justice Vipul M. Pancholi disposed of a writ petition filed by Namrata Neopaney and others, directing them to approach the High Court on its judicial side instead. To protect the petitioners in the interim, the apex court ordered a six-week stay on their termination order to allow them to file their petition.

The case originated when an order of termination was passed against the petitioners. Representing the petitioners, learned counsel argued that the High Court’s full court had passed the order of termination without considering their substantive representation on the matter. Seeking immediate relief, the petitioners filed a writ petition along with a stay application before the Supreme Court.

During the hearing, the Supreme Court addressed the jurisdictional aspect of challenging a High Court’s administrative action on its own judicial side. The bench clarified the legal position, noting: “We are of the view that the petitioner may approach the High Court in the judicial side. There is no embargo on the High Court to entertain a Writ Petition against its own administrative order.”

Based on this analysis, the court decided to refer the petitioners back to the High Court while ensuring they are protected during the transition period. The bench ordered: “The order of termination shall not be given effect to for a period of six weeks from the date to enable the petitioner to approach the High Court.”

The court disposed of the writ petition and all pending applications, while explicitly clarifying that “All contentions are kept open” for the parties to argue before the High Court.
