A petition was filed before the High Court of Madras where the petitioners who were charged under Section 306 IPC and were in custody, had sought bail.
The Court granted bail to the husband but denied bail to the mother and sister in law of the deceased.
Brief Facts of the Case:-
As per the complainant, his daughter was married to the accused Banu Chander. Due to the Covid 19 pandemic, the couple moved to the native place of the husband.
At the husband’s native place, the victim was tortured by the mother and sister in law due to which the wife committed suicide.
Proceedings before the Hon’ble High Court
Learned counsel for the petitioner stated that the victim committed suicide by hanging because she had lost her job due to Covid -19 pandemic.
It was argued that the petitioners were falsely implicated in the case and have been wrongly imprisoned.
Counsel for the respondents denied the claims of the petitioners and stated that the petitioners assaulted the deceased due to which she had to get sutures on her head.
It was further argued that due to the assault, she got frustrated and committed suicide.
Decision of the Court
Hon’ble Court declined to grant bail to the mother and sister in law of the deceased. However, considering the nature of allegations and incarceration of the husband, the Court granted bail to the husband of the deceased.
