Madhya Pradesh High Court Upholds Woman’s Right To Live Independently In Mumbai, Urges Continued Family Contact

The Madhya Pradesh High Court has dismissed a petition seeking the production of an adult woman who relocated to Mumbai, ruling that she possesses the legal freedom to live independently after establishing that she moved voluntarily and is not being unlawfully detained.

A division bench of Justice G. S. Ahluwalia and Justice Anuradha Shukla delivered the decision on October 6, observing that the woman had secured employment and relocated of her own volition. While recognizing her personal autonomy, the judges advised her against severing ties entirely with her family, urging her not to hesitate to contact her parents or return home if she ever finds herself in a vulnerable situation or in need of support.

Voluntary Relocation Confirmed

The proceedings took place after a writ petition was filed seeking to secure the woman’s appearance before the court. During the hearing, the woman, an advocate enrolled with the Bar Council of Madhya Pradesh, appeared remotely via video conference. She informed the bench that she was residing in Mumbai by personal choice, had obtained a job, and was not being subjected to illegal confinement.

Addressing allegations regarding her living arrangements, the woman clarified that she was staying at the residence of a friend rather than with an individual who had been identified as a respondent in a separate proposed legal filing.

Concerns Over Medical Care

The woman’s father addressed the bench during the hearing, stating that his daughter had previously received medical treatment for schizophrenia. He requested that she continue her medical regimen, emphasizing that she should do so regardless of whether she decided to return to her parental home. The bench noted that the father’s statements reflected genuine concern for his daughter’s well-being.

Responding to the submission, the woman stated that a psychiatrist she consulted had told her she was not suffering from the condition, though a formal mental health evaluation would require a judicial directive. She informed the court that she would agree to undergo treatment if a designated assessment confirmed it was necessary, adding that any future decision to reunite with her family would be made on her own terms.

The bench was also briefed on related legal steps being taken in Maharashtra. Counsel representing the state informed the court that the woman intended to move the Bombay High Court seeking protection for her life, personal safety, dignity, and liberty, along with a formal declaration affirming her legal right as an adult to independently determine her place of residence, education, profession, associations, relationships, and matrimonial plans.

When initial searches on the Bombay High Court portal showed no registered record of the matter, the state counsel requested a temporary adjournment. Following a 30-minute pass-over, counsel reported that they had communicated with the lawyer handling the matter, who confirmed that the petition had not yet been registered but was scheduled for formal filing later that day.

Closure Of Proceedings

After reviewing her statements and confirming that she was living in Mumbai without coercion, the high court concluded that no grounds remained to keep the matter pending. The bench subsequently dismissed the petition, granting the woman full liberty to lead her life according to her own choices.
