Today, the Government of NCT of Delhi Amendment Bill enhances Lieutenant Governor’s powers and limits the elected government’s power in some aspects.
The said amendments were made to the Government of National Capital Territory of Delhi Act, 199.
Highlights of the New Bill:-
Following is sought to be added to Section 21 The expression ‘Government’ referred to any law made by the Legislative Assembly shall mean the Lieutenant Governor.“
Through the Bill, the Lieutenant Governor powers will now be extended by amending Section 24 of the 1991 Act that bills with Assent to Bill.
These changes will be brought to Section 33 of 1991 so that the Legislative assembly cant make any rule for enabling itself or its committee for considering matters of day to day administration of Delhi or related to its administration. This provision would be retrospective in nature.
In Section 5, a provision would be added to Section 44 of the 1991 Act. The government has to obtain the Lieutenant Governor’s opinion on all matters before they take any executive action.
As per the Central Government, the changes were made due to the Supreme Court’s observation in the Government of NCT of Delhi vs Union of India.
However, Delhi CM Arvind Kejriwal has condemned the Bill as unconstitutional and anti-democracy.
