Lawyer jailed for sending birthday wishes to a sitting judge

Today, the Madhya Pradesh High Court will hear a bail plea filed by a jailed lawyer for sending birthday wishes and a card to a judge.

The Ratlam police arrested advocate Vijay Singh Yadav on February 9 after sending an email and birthday card to Judicial Magistrate (First Class) Mithali Pathak on January 9. The complaint states that he downloaded the judge’s photo from her Facebook account and attached it to the birthday card.

It is further alleged that Yadav had downloaded the judge’s photo without authorisation, and then he sent the birthday wish/card to her official email account.

As the lawyer was not a Facebook friend with the judge, such unauthorised access would attract the Information Technology Act provisions.

The FIR was lodged for offences punishable under Section 420 (, 467, 468, 469 Section 41 of IPC read with section 67 of the Information Technology Act, 2000.

On 13.02,2021, the family members of lawyers had applied for bail, but the court rejected it.

Therefore, a bail application was filed in the Madhya Pradesh High Court.

In his plea. The lawyer stated that unnecessary charges have been levelled against him and that he had no intention to harm the judge’s reputation. He also submitted that he did not know a lot about social media and internet access.

The bail plea will now be heard by the Indore Bench of Madhya Pradesh High Court.
