“It is true that the medical report does not corroborate the prosecution story” submits Government on Anticipatory Bail Plea of Government Counsel Accused of Sexual Harassment by Young Lawyer. HC directs to file Reply [READ ORDER]

A Government Counsel of Lucknow High Court who has been accused of Sexual Harassment by a Young Lawyer has moved Anticipatory Bail plea before the Lucknow High Court. The Bail No. 5862 of 2020 has been heard by the bench of Justice K.S. Pawar on 28.08.2020 and after hearing both the parties the Court directed the Government to file an affidavit of the investigating officer giving parawise reply to the bail application, annexing therewith copy of the statement(s) of the prosecutrix recorded under Sections 161 CrPC and 164 CrPC, as also the viscera report, by the next date of listing. The next date of hearing has been fixed for 03.09.2020

During the hearing of Anticipatory Bail Plea the Government submitted that  “it is true that the medical report does not corroborate the prosecution story. No injury is seen on the person of the prosecutrix. Medical report also does not show that spermatozoa was seen in given sample of vaginal smear, either live or dead.”

However on the query of the court with respect to Viscera Report, the Court was informed that viscera report is still awaited from the Forensic Science Laboratory.
