A person approached the Kerala High Court and requested that he should be handed back the property that was taken over by the respondent for Covid Care.
The Court directed the respondent to hand over the property after getting it cleaned and disinfected.
What was the petitioner’s reason to approach the Court?
In the instant case, the resort owned by the petitioner was taken over by the respondent no.1 to accommodate people who were under Covid-19 observation.
The petitioner submitted that he is dependent on the agricultural income that is generated by the farm.
Because the respondent no.1 has taken over the farm, his income has ceased.
The Stand of the Government Pleader
Learned Government Pleader informed the Court that the keys to the cottages located on the land had been given to the Panchayat who will pass on the keys to the petitioner.
It was further submitted that the petitioner is insisting that the cottages should be cleaned and a joint inspection of the property should be conducted.
Clean the Premises
Hon’ble Kerala High Court held that the cottages should be cleaned and disinfected before the possession was handed to the petitioner as they were used for Covid Care.
So, the respondents were directed to complete the entire cleaning process within two weeks.
