Chief Justice of India (CJI) B.R. Gavai on Friday underscored the importance of judicial activism in safeguarding the Constitution and citizens’ rights, while cautioning against its misuse as a tool for judicial overreach or “judicial terrorism.”
Speaking at a felicitation ceremony hosted by the Nagpur District Court Bar Association, CJI Gavai emphasized the need for a balanced approach among the three pillars of Indian democracy — the legislature, executive, and judiciary. “All three wings have been given their limits and boundaries. They must function within the framework of the law,” he said.
Highlighting the judiciary’s role as a corrective force, the Chief Justice noted that the courts have the authority to intervene when Parliament exceeds its legal bounds. However, he warned, “Though judicial activism is bound to stay, it should not be permitted to be converted to judicial adventurism and judicial terrorism.”

CJI Gavai, who assumed office as the 52nd Chief Justice of India last month, reiterated that judicial activism plays a crucial role in upholding constitutional values and ensuring justice for all sections of society.
In his speech, he paid tribute to Dr. B.R. Ambedkar, calling him a towering social reformer and jurist. “The entire nation remains indebted to Dr. Ambedkar for his immense contribution to our democracy and legal framework,” he said.
CJI Gavai also lauded the inclusive spirit of the Nagpur bar, describing it as “the most secular bar,” where lawyers from different faiths work across communal lines. “I have seen Hindu lawyers working passionately for the Muslim community, and vice versa. This is the true spirit of Indian secularism,” he remarked.
