Recently, the Himachal Pradesh High Court ruled that it is not permissible for the High Court to convert a lesser offence into a serious offence in an appeal for enhancement of sentence. The bench of Justice Rakesh Kainthla was dealing with the appeal challenging the order of conviction and sentence passed by the Trial Court.
