High Court Stunned by Civil Court Rulings, Recommends Training for Judges

The High Court expressed astonishment at the decisions made by the junior division civil judge and the fast track district judge in Mainpuri, suggesting that both judges might require further training. This remark came during a hearing on a second appeal filed by one Shailendra alias Shankar Verma, concerning a disputed property matter.

Justice Kshitij Shailendra reviewed the rulings from the Mainpuri civil courts involved in Verma’s civil lawsuit. The High Court noted an apparent lack of understanding by the junior civil judge concerning how to handle counterclaims effectively. It was surprising that the defense presented two witnesses whose testimonies were not considered at all, indicating a possible oversight in trial procedures.

The court observed that neither the plaintiff’s claim nor the counterclaims were properly addressed in the civil court’s decision, which seemingly rendered the conclusions meaningless. The operational part of the decision simply declared the defendant’s suit dismissed without proper consideration of the arguments presented.

Equally surprising was the performance of the district judge of room number two, who also failed to grasp the proceedings correctly. The High Court remarked that it seemed both courts had failed in their duties as civil courts, merely fulfilling the formalities of writing a decision without proper adjudication.

Acknowledging these concerns, the High Court has accepted the second appeal for hearing and issued notices to the opponents, marking a critical juncture in the ongoing legal battle over property rights.
