HC Seeks Answers on Not Giving Widow Reservation to Married Women in Other States

Rajasthan High Court has sought reply from Principal Education Secretary, Director of Elementary Education and Staff Selection Board for not giving the benefit of widow reservation to a woman native of the state due to her marriage in another state in Third Class Teacher Recruitment-2022. Along with this, the court has asked to keep one post vacant for the petitioner. A single bench of Justice Arun Bhansali gave this order while conducting the preliminary hearing on Vinod Kumari’s petition.

In the petition, advocate Sunil Kumar Singodia told the court that the petitioner is a native of Rajasthan. He was married in Punjab. Where after a few years her husband died. The Staff Selection Board released the recruitment for Third Grade Teacher Level One on December 16, 2022. In which the petitioner applied under widow quota. In the cut off released by the board, the petitioner has more marks than the cut off of widow category. In such a situation, he was called for document verification, but after document verification, the selection board did not send the name of the petitioner to the state government for appointment.

The petitioner was told that due to her marriage outside the state, she could not be given the benefit of widow reservation. It was said in the petition that the petitioner is a native of the state. In such a situation, he cannot be denied reservation merely on the basis of his marriage taking place outside the state.

The Education Department has also given instructions that female candidates marrying outside the state will be given appointment as per their own category. Despite this, the petitioner is not being given appointment. While hearing this, the single bench has sought response from the concerned officers and asked them to keep one post vacant for the petitioner.
