Four-Minute Delay in Informing Arrest Grounds Does Not Invalidate Arrest: Bombay High Court

The Bombay High Court has upheld the legality of an arrest despite a minor delay in communicating the grounds of arrest, marking a significant judicial stance on the timeliness of procedural requirements in criminal cases. The ruling emerged from a petition filed by Gunwant Tarachand Jain, a 34-year-old Bhaindar resident involved in a rape case.

Jain was arrested at 10:56 PM on November 21 by the Versova police, shortly after a case was registered against him. According to police records, the grounds of arrest were communicated to him at 11:00 PM, four minutes post-arrest. Jain contested the legality of his arrest on the basis that this brief delay violated the standards set by the Supreme Court, which require immediate communication of arrest reasons to safeguard the accused’s legal rights.

The initial ruling by the Andheri magistrate court sided with Jain, labeling the arrest as illegal due to the four-minute delay. However, this decision was overturned by the Dindoshi sessions court on December 24, which argued that the delay was not unreasonable under the circumstances, thus rendering the arrest valid.

Seeking further legal remedy, Jain escalated the matter to the Bombay High Court, where Justice Dr. Neela Gokhale presided over the case. In her judgment, Justice Gokhale noted that the police had adhered closely to the legally mandated arrest procedures and that the slight delay did not amount to a violation of Jain’s fundamental rights.

“The grounds of arrest are conveyed to the petitioner within four minutes of his arrest,” observed Justice Gokhale in her ruling. “There is no violation of any fundamental right of the petitioner.”
