Failing to Examine Independent Witness Raises Adverse Inferences Against Prosecution: Supreme Court Acquits Murder Convict

The Supreme Court on Wednesday stated that failing to examine independent witnesses raises adverse inferences against prosecution. The bench of Justices B.R. Gavai and Pamidighantam Sri Narasimha stated that “though independent witnesses were available, the prosecution has failed to examine them. This is a case wherein the appellants are entitled to benefit of the doubt.”
