Even High-Profile Terrorists Like Ajmal Kasab Received Fair Trials In India: Supreme Court To CBI During Yasin Malik’s Hearing

The Supreme Court of India has reiterated the importance of a fair trial, invoking the case of terrorist Ajmal Kasab during proceedings involving Kashmiri separatist Yasin Malik. The Central Bureau of Investigation (CBI) is appealing against an order that mandates Malik’s physical appearance in a Jammu court for the 1989 killing of four Indian Air Force (IAF) personnel.

Justice Abhay S Oka and Justice Augustine George Masih heard arguments concerning the logistical and security challenges of transporting Malik to Jammu. Solicitor General Tushar Mehta highlighted the security risks and Malik’s reluctance to engage legal representation, contrasting his demands to appear in person with his known connections to Pakistani militant Hafiz Saeed.

Justice Oka questioned the feasibility of conducting cross-examination remotely given the connectivity issues in Jammu, prompting Mehta to assert the uniqueness of Malik’s case due to his frequent interactions with known terrorists.

Despite these challenges, Justice Oka maintained that even high-profile terrorists like Ajmal Kasab received fair trials in India, emphasizing the judiciary’s commitment to due process. The discussion also touched upon potential alternative arrangements for the trial, such as conducting it within jail premises, to address security concerns.
