The Delhi High Court has been approached by 80-year-old Rani Kapur, mother of late industrialist Sunjay Kapur, seeking a declaration that the ‘RK Family Trust’—allegedly constituted in her name in 2017—is “null and void”, citing fraud and forgery.
In her civil suit, Rani Kapur has alleged that the trust was created through “forged, fabricated and fraudulent” documents, and that she was unaware of being divested of her rights and legacy. She has sought a permanent injunction restraining her daughter-in-law Priya Kapur, along with other family members including grandchildren, from acting in furtherance of the RK Family Trust in any manner.
According to the plea, Rani Kapur was the sole beneficiary of the estate of her late husband, Surinder Kapur, the promoter of the Sona Group of Companies. She claims that a “systematic fraud” was committed in transferring these assets to the RK Family Trust without her knowledge or consent.
The trust, which was supposedly set up in October 2017, was allegedly created using her name but without her awareness or signature. She asserts that Sunjay Kapur never informed her about any divestment of her rights during his lifetime and never shared any copy of the trust deed.
“By means of a complex web of illegal transactions undertaken by the defendant Nos. 1 to 9… in an unfortunate collusion with the plaintiff’s now deceased son… all the plaintiff’s assets vest in one fraudulent trust,” the plea states.
The lawsuit includes as parties Sunjay Kapur’s two children from his second marriage with actor Karisma Kapoor. Notably, the two children have separately filed a case in the Delhi High Court challenging the authenticity of their father’s purported will. In that matter, they have reportedly alleged that their stepmother Priya Kapur was “greedy”.
Sunjay Kapur passed away on June 12 this year after suffering a cardiac arrest during a polo match in England. He was a prominent businessman associated with several automotive and engineering ventures under the Sona Group.
The RK Family Trust, now under scrutiny, is central to an escalating family dispute over succession, control of assets, and allegations of deceit. The legal proceedings are expected to delve into the validity of the trust deed, the chain of transactions leading to its creation, and the scope of beneficiaries.
The matter is now before the Delhi High Court. It remains to be seen whether the court will issue interim relief or initiate an inquiry into the allegations raised by Rani Kapur.
