Delhi Court Summons Litigant for Smoking During Virtual Hearing

In an unusual breach of court decorum, a Delhi court has summoned a litigant for smoking a cigarette during a video conference proceeding. The incident, which took place on Wednesday, has prompted the court to demand an explanation from the individual on why disciplinary action should not be taken against him.

District Judge Shiv Kumar issued the order for the litigant, identified as Sushil Kumar, to appear in person at the next hearing scheduled for March 29, 2025. The judge expressed his disapproval of Kumar’s actions, which were deemed disrespectful and disruptive to the judicial process.

According to the order, Sushil Kumar was initially spotted talking on the phone during the proceedings, which was already disrupting the ongoing hearings. Despite being instructed to cease this activity, Kumar continued to disregard the court’s directions. This led to him being muted during the video call to prevent further disturbances.

However, the situation escalated when a court staff member, temporarily managing the video conferencing facilities, observed Kumar smoking a cigarette while an order was being dictated. This act of smoking, visible on camera, was seen as a serious violation of the conduct expected in court settings, especially during a time when proceedings were actively being conducted.

Upon being confronted about his behavior, Kumar apologized to the court and assured that such misconduct would not be repeated. Nevertheless, the judge found it necessary to issue a formal notice and summon him to provide a detailed explanation for his actions.
