Bar Council Temporarily Bars Advocate from Practice for Misconduct and Abuse Against Judiciary

The Bar Council of Tamil Nadu and Puducherry has temporarily prohibited an advocate from practicing before any court, tribunal, or legal forum in India following serious allegations of professional misconduct and use of obscene language against courts and judges.

The decision, dated 4 July 2025, comes after the Madras High Court directed police to initiate criminal proceedings against the lawyer for obstructing law enforcement officers and for his repeated abusive conduct in court proceedings.

In its official statement, the Bar Council noted:

“The Bar Council has perused the entire records and has passed a resolution prohibiting said advocate from practicing as an Advocate before all Courts, Tribunals and other authorities in India either in his name or in any assumed name till the disposal of the disciplinary proceedings initiated by the Bar Council.”

The High Court had earlier directed the police to act against the advocate after it was revealed that he had obstructed officers from executing a non-bailable warrant (NBW) issued against his clients, who were facing contempt proceedings. The Court observed that the advocate used inappropriate and abusive language toward the judiciary and instructed the Bar Council to take disciplinary action.

Justice PT Asha, while expressing deep concern over the advocate’s conduct, had stated:

“Considering the fact that a member of this noble profession has acted in such a fashion which has brought discredit to the profession, Mr. CK Chandrasekar, learned standing counsel for the Bar Council of Tamil Nadu and Puducherry present before this Court is directed to take necessary steps to initiate proceedings…”

The matter came to light when the clients, during the hearing, informed the Court that they were unaware of the contents of a legal application filed on their behalf. They believed it related to a property dispute, but the document—drafted solely by the advocate—was actually seeking a transfer of proceedings. The clients said they were not adequately informed due to the application being in English and the lack of explanation by their counsel.

The High Court found the language in the application to be disrespectful toward judges, including a judicial officer of the Labour Court, and remarked that the affidavit’s contents—entirely written by the lawyer—were deeply troubling.

Taking cognizance of these facts, the Bar Council suspended the advocate from legal practice pending the outcome of its disciplinary proceedings.
