Allahabad High Court Slaps ₹1 Lakh Fine on Litigant for Concealing Legal Facts

The Lucknow bench of the Allahabad High Court has imposed a significant penalty of ₹1 lakh on a petitioner after discovering the “suppression of material facts” in a criminal matter. Justice Brij Raj Singh issued the order on Wednesday, dismissing the plea and rebuking the litigant for failing to disclose ongoing proceedings in a lower court.

The case reached the High Court through a petition filed by Chandrama Devi Agrahari. The petitioner was seeking to challenge a summoning order issued by the Additional Chief Judicial Magistrate (ACJM) court in Sultanpur.

However, during the hearing, the court found that Agrahari had already initiated a criminal revision petition against that very same summoning order in the Sultanpur sessions court. By failing to mention this existing legal challenge in her High Court filing, the petitioner was found to have intentionally concealed vital information from the judiciary.

Taking a serious view of the concealment, Justice Singh dismissed the petition and directed the petitioner to pay ₹1 lakh as a “cost.” The court outlined a specific distribution for the penalty amount:

  • ₹30,000 is to be paid directly to the original complainant in the criminal case.
  • ₹70,000 must be deposited with the State Legal Services Authority.

The ruling serves as a stern reminder of the “clean hands” doctrine in Indian law, which requires litigants to be entirely transparent when approaching the court. By pursuing identical relief in two different courts simultaneously without disclosure, litigants risk wasting judicial time and facing heavy financial penalties.

In this instance, the High Court’s decision to award a portion of the fine to the complainant highlights the intent to compensate those affected by prolonged or misleading legal maneuvers.
