Allahabad High Court Uphholds District-Wise Policy For Uttar Pradesh Primary Teacher Transfers

The Allahabad High Court has ruled that primary school teachers in Uttar Pradesh cannot demand postings to specific individual schools when seeking inter-district transfers, affirming that such relocations must be evaluated on a district-wide basis under state policy.

Dismissing a petition filed by four assistant teachers, the Lucknow bench of the court upheld the Uttar Pradesh government’s June 2026 transfer policy. Justice Pankaj Bhatia determined that utilizing district-level Pupil-Teacher Ratio (PTR) metrics for transfer administrative exercises does not violate the Right to Education (RTE) Act, ruling that teachers hold no inherent statutory right to transfers beyond what state policy grants.

District Metrics Distinguished From Statutory Obligations

Addressing the legal challenge, the high court drew a distinction between executive transfer guidelines and statutory mandates under federal law. Justice Bhatia noted that the state compiled district-wise PTR figures solely to determine which districts could receive incoming teachers.

The court held that employing district-level ratios for administrative transfers does not affect the statutory PTR compliance required under the RTE Act. It further clarified that the decision does not serve as an endorsement of the government’s PTR data for evaluating compliance with RTE Act standards.

Origins Of Legal Challenge And RTE Arguments

The dispute centered on a government order issued on June 22, which established PTR figures for the transfer process. The four petitioners, who were appointed under the Uttar Pradesh Basic Education (Teachers) (Posting) Rules of 2008, challenged the order on the grounds that the RTE Act mandates PTR calculations to be maintained school-wise and class-wise.

Relying on a Kerala High Court precedent that was later affirmed by the Supreme Court, the teachers contended that district-wide metrics restricted their ability to make informed decisions when requesting relocations.

Policy Framework And Transfer Criteria

Under the 2008 posting rules, basic school teachers face general restrictions on transfers outside exceptional circumstances. However, a state order released on June 4 created exemptions for specified categories, including cases where spouses work in different districts.

Under that provision, when both spouses serve as basic school teachers, transfer requests can be considered for districts demonstrating a lower PTR.

Finding that the state’s district-based criteria did not infringe upon any legal rights of the petitioners, the court concluded there was no justification to interfere with the policy and dismissed the writ petition.
