Recently, Allahabad High Court granted bail to a man accused of sending an objectionable message regarding the French President and asked people to display black flags as a mark of protest at their shops, houses and other establishments.
Hon’ble Justice Dinesh Kumar Singh was hearing an application for bail filed by the accused u.s 505(1)(b), 505(2), 153A and 109 of IPC and u/s 67 of IT Act.
Learned counsel for the petitioner submitted that the accused did not inscribe the forwarded message, and he just sent it without realising the gravity. He also stated that the accused has tendered an unconditional apology and will not indulge in such activities.
Hon’ble Court asked the counsel to file an affidavit regarding the unconditional apology and state that he will believe in communal harmony and peace.
The accused-appellant submitted the said affidavit in court.
Order of the Court:
The Court granted bail to the accused as he had tendered an apology and had no past criminal history. The Bench further directed that the applicant will be released after furnishing a personal bond and sureties to the Court’s satisfaction.
