Allahabad HC: Absence of a Penal Clause for Non-Compliance Makes the Provision Directory, Not Mandatory

In a significant ruling, the Allahabad High Court has directed the State of Uttar Pradesh to refund the earnest money of ₹90 lakhs to M/S Pragyason Constructions Private Limited. The court quashed the orders of the District Magistrate and the Secretary, Mines and Minerals, U.P., which had previously rejected the company’s application for a refund.
