The Patna High Court has stayed the deputation order of an associate professor battling stage-5 chronic kidney disease and directed Patliputra University to sympathetically re-evaluate his request for a transfer closer to Patna within two weeks.
Justice Harish Kumar issued the ruling on August 7 following a petition by the Hindi academic, who is assigned to M D College in Naubatpur. The petitioner, who requires urgent ongoing treatment at medical facilities including AIIMS Patna and CMC Vellore, had challenged his transfer to a distant college.
Deputation Issued Without Consent
The court action follows a June 20 university order appointing the professor as in-charge principal at the newly established Rajkiya Degree College in Ghoswari, Patna. The court noted that the university issued this decision without obtaining the academic’s consent.
Prior to the deputation order, the professor had submitted a formal request on March 17 seeking a transfer to B.S. College in Danapur, where a position was vacant, citing his medical condition. After receiving the Ghoswari assignment, he submitted additional representations for relief, but the university took no action, leading him to file a petition with the high court.
Court Emphasizes Medical Urgency
In its order, the high court highlighted the terminal nature of the petitioner’s condition and the necessity of immediate medical care. The bench noted that the vice chancellor must reconsider the case sympathetically given the professor’s fragile health.
Representing Patliputra University, advocates Anand Kumar, Rajan Prakash, and Pragya Kiran asked for a brief adjournment to determine the current status of the matter. The court noted that the university provided no substantive counter-arguments regarding the petitioner’s health or transfer request.
The high court suspended the execution of the June 20 deputation order regarding the professor while the vice chancellor conducts the required review.
